01 Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of the MyGuest mobile application, the website at joinmyguest.com, and all related features and services (together, the “Service”), provided by MyGuest (“MyGuest”, “we”, “us”, “our”). By downloading, accessing, or using the Service, or by clicking to accept, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.
If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation, and “you” includes that organisation.
02 Definitions
- Host — a user who creates an event and invites guests, together with the team members they authorise.
- Guest — a person who accesses an event using an invitation code.
- Event — a wedding, celebration, corporate event, trip, or other gathering managed through the Service.
- Content — any information, text, images, audio, or other material submitted through the Service.
03 Eligibility & accounts
You must be capable of forming a binding contract under applicable law to use the Service. Hosts and team members are responsible for keeping their login credentials confidential and for all activity under their account. Guests access their event using an invitation code provided by a host and are responsible for keeping that code reasonably private. You agree to provide accurate information and to notify us promptly of any unauthorised use of your account. We may refuse, suspend, or reclaim any account, code, or username at our discretion.
04 The Service
MyGuest is a guest-management and event-hospitality platform. It lets hosts create events, invite guests, and coordinate details such as RSVPs, itineraries, agendas, arrivals, seating, announcements, rituals, entertainment, gift registries, and host-funded guest perks; and it lets guests view their event and share their preferences. Features vary by event type, plan, and device, and we may add, change, or remove features at any time. The Service is a tool that helps you organise an event — it does not host the event itself, and we are not the organiser of, or a participant in, any event you manage or attend.
05 Host responsibilities & warranties
- Provide accurate event and guest information, and only add and contact guests you are authorised to add and contact.
- Obtain any and all consents and permissions required to enter guests’ personal details and to share them with your team and service providers.
- Use the Service lawfully; comply with all applicable laws, including those on privacy, messaging, and consumer protection; and do not send unsolicited or unlawful communications.
- Be solely responsible for your event, your guests, your vendors, your payments, and all decisions you make using the Service.
You represent and warrant that you have the rights and consents necessary for everything you submit or do through the Service, and you accept full responsibility for your compliance with the above.
06 Guest responsibilities
As a guest, you agree to provide accurate information about yourself, to use the Service only for the event you were invited to, and not to misuse another guest’s code or access information you are not authorised to see. Information you submit is shared with your event’s host and their authorised team so they can host you.
07 Acceptable use
You agree not to, and not to allow anyone to:
- use the Service for any unlawful, harmful, fraudulent, infringing, or abusive purpose;
- upload content you do not have the right to share, or that is illegal, obscene, defamatory, or violates another person’s rights;
- send spam, or harvest, scrape, or misuse guest data;
- attempt to breach or circumvent security, access accounts or data you are not authorised to access, or probe or test the Service’s vulnerability without our written permission;
- reverse engineer, decompile, or attempt to extract source code, except to the limited extent the law expressly permits;
- interfere with, overload, or disrupt the Service or its infrastructure, or introduce malware;
- resell, sublicense, or commercially exploit the Service except as we expressly permit; or
- use the Service to build or train a competing product, or misrepresent your affiliation with us.
We may investigate and take any action we consider appropriate for a suspected violation, including removing content, suspending access, and cooperating with authorities.
08 Guest-capacity packs & payments
Core features are provided free. Additional guest capacity is purchased as packs through our payment provider. All fees are quoted inclusive or exclusive of taxes as indicated at purchase, and applicable taxes are your responsibility. Except where required by law or expressly stated by us, payments are non-refundable, and capacity, once granted, is consumed as you use it. We may change pricing prospectively. Chargebacks or payment reversals made in bad faith may result in suspension. You are responsible for the accuracy of the payment details you provide to the payment provider.
09 Gift contributions
Gift contributions are made directly by guests to a host’s own UPI ID through the guest’s own payment app. MyGuest merely provides a convenience record of what a guest self-reports.
MyGuest is not a party to, does not process, does not hold, and is not responsible for any such transfer, its success or failure, its amount, any tax on it, or any dispute between a guest and a host about it. Any issue with a gift transfer is strictly between the guest, the host, and their payment providers.
10 Your content & licence to us
You retain ownership of the Content you submit. You grant MyGuest a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, process, adapt, and display your Content solely to operate, provide, secure, and improve the Service for your event, and to the limited extent needed to comply with law. You represent that you have all rights necessary to grant this licence and that your Content does not infringe or violate any third-party rights. We may remove any Content at our discretion, and we are not obligated to store or return Content.
11 Intellectual property
The Service — including its software, design, text, graphics, logos, and the “MyGuest” name and branding — is owned by MyGuest and its licensors and is protected by intellectual-property and other laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for its intended purpose. All rights not expressly granted are reserved. These Terms grant you no rights in our trademarks or branding. Any feedback you provide may be used by us without restriction or obligation to you.
12 Third-party services & links
The Service integrates with or links to third-party services (such as authentication, hosting, media storage, payment, messaging, mapping, and device notification providers). We do not control and are not responsible for third-party services, their availability, or their terms and privacy practices, and your use of them is at your own risk and subject to their terms.
13 Disclaimers
The Service is provided “as is” and “as available”, with all faults and without warranties of any kind, whether express, implied, statutory, or otherwise.
To the maximum extent permitted by law, MyGuest disclaims all implied warranties, including merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or free of harmful components; that any notification, invite, reminder, or message will be delivered, delivered on time, or received; that data will never be lost; or that the Service will meet your requirements or produce any particular result. Any material obtained through the Service is used at your own discretion and risk.
14 Assumption of risk
You acknowledge that planning and attending events involves risks that MyGuest does not control — including changes to schedules, venues, travel, weather, vendors, third-party conduct, and force-majeure events. You assume all such risks. MyGuest is a coordination tool only and is not responsible for the planning, conduct, safety, quality, or outcome of any event, or for the acts or omissions of any host, guest, vendor, or other third party.
15 Limitation of liability
To the maximum extent permitted by law, MyGuest and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business, arising out of or relating to the Service — even if advised of the possibility of such damages, and regardless of the theory of liability.
Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid to MyGuest for the Service in the three (3) months before the event giving rise to the claim, or (b) one thousand Indian Rupees (₹1,000).
These limitations apply to all claims, whether based in contract, tort (including negligence), statute, or otherwise. Some jurisdictions do not allow certain exclusions or limitations; in those places, our liability is limited to the smallest amount permitted by law. This section reflects an agreed allocation of risk and survives termination.
16 Indemnification
You agree to defend, indemnify, and hold harmless MyGuest and its owners, employees, and suppliers from and against any and all claims, demands, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Service; (b) your Content; (c) your event, your guests, or your vendors; (d) your violation of these Terms or of any law or third-party right; or (e) any gift or payment transfer you make or receive. We may assume the exclusive defence of any matter subject to indemnification, in which case you agree to cooperate.
17 Force majeure
MyGuest is not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, epidemics, war, civil unrest, government action, labour disputes, internet or utility failures, or the acts or omissions of third-party providers.
18 Suspension & termination
You may stop using the Service at any time. We may suspend, limit, or terminate your access — with or without notice — if we reasonably believe you have violated these Terms, created risk or legal exposure for us or others, or if we discontinue the Service. On termination, your right to use the Service ends immediately. Provisions that by their nature should survive — including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution — survive termination.
19 Governing law
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of India, without regard to conflict-of-laws principles. Subject to the arbitration provision below, the courts located in India (at the seat of MyGuest’s operations) will have exclusive jurisdiction, and you consent to that jurisdiction and venue.
20 Dispute resolution, arbitration & class-action waiver
Before starting any formal proceeding, you agree to first contact us at hello@joinmyguest.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days.
If the dispute is not resolved, it will be finally settled by binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended). The arbitration will be conducted by a sole arbitrator appointed in accordance with that Act, seated in India at the seat of MyGuest’s operations, and conducted in English. The arbitrator’s award is final and binding, and judgment on it may be entered by any court of competent jurisdiction.
To the extent permitted by law, all disputes will be resolved on an individual basis only. You and MyGuest waive any right to bring or participate in a class, collective, consolidated, or representative action.
Nothing in this section prevents either party from seeking urgent interim or injunctive relief from a court to protect its rights pending arbitration.
21 Changes to the Service & these Terms
We may modify the Service or these Terms at any time. When we change the Terms, we will update the “Last updated” date, and for material changes we will take reasonable steps to notify you. Changes are effective when posted (or on any later date we specify). Your continued use of the Service after changes take effect means you accept the revised Terms; if you do not agree, stop using the Service.
22 General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and MyGuest regarding the Service and supersede any prior understanding.
- Severability. If any provision is held unenforceable, it will be limited or removed to the minimum extent necessary, and the rest remains in full force.
- No waiver. Our failure to enforce any right is not a waiver of it.
- Assignment. You may not assign these Terms without our consent; we may assign them freely, including in connection with a merger, financing, or sale.
- Notices. We may provide notices through the Service or by email; you consent to electronic communications.
- Relationship. Nothing here creates a partnership, agency, employment, or joint venture between you and MyGuest.
